March 2012 Alimony Reform
Effective March 1, 2012, new alimony reform laws have gone into effect in Massachusetts. Among other changes, the new reforms use a new formula for determining support based on the potential recipient’s actual need and the paying spouse’s ability to provide the support. There are also new time limits on the length that alimony can continue and the legal recognition of different types of alimony. These changes are sweeping and comprehensive, but the application of these new laws to an individual’s situation will be, as it always has been, largely determined by the individual judge.
The good news about the alimony reforms is that they go a long way to limit the potential for abuse of the system. The more difficult aspect of these reforms is that they will drastically change our approach to negotiating and litigating this type of dispute.
